Thursday, Sep 3, 2009 @09:18pm CDT Austin police will enforce the first no refusal weekend since new DWI laws took effect Tuesday. Senate Bill 328 says police don't need a search warrant to draw blood from certain suspected drunk drivers. Those alleged drunk drivers who refuse a breath test will have blood drawn Labor Day weekend, something a DWI attorney says you shouldn't consent too. "Police like to trick you into consenting," says Austin attorney Jamie Balagia. “Never give away your rights." Earlier this week, police say they were in hot pursuit of suspected drunk driver Jaime Alvarado when he slammed his SUV into Robert Benn. "I would encourage anybody who is going to be out drinking this weekend or at any time to assign a designated driver,"says Austin MADD director Karen Housewright. Austin is full of bars especially downtown entertainment district. Residents running along Lady Bird Lake tell KEYE TV, they are split on whether Austin police should be in the blood business. "Part of me thinks that's it's an invasion of privacy, and I'm against that,” says Jessica Hendrix. “I would like to see less drunk drivers on the road." The Austin police department says drawing blood could be crucial in court cases. "The more evidence that we have when it comes time for a trial, the better case we can present,"says APD spokesman Scott Perry. State law says police don't need a search warrant for blood if you have a previous DWI arrest or charge. The other exceptions are if you there’s a child in the car under eleven or you're involved in a crash. KEYE TV talked to several attorneys who say they are looking forward to challenging this law in court. |
